The Guarantor of the Debtor in PJSC "Alfa-Bank” is Free from Liability

Dear clients!  We are happy to report  the next victory of the LF "Moskalenko & Partners" over the PJSC "Alfa-Bank". Shevchenkivskiy district court of Kyiv  has recognized the guarantee  be the contract of guarantee  terminated, on the basis of increasing responsibility debtor without the consent of the guarantor.
Appellate Court of Kyiv upheld the decision of the first instance court. PJSC "Alfa-Bank" in order to insure the continuation of guarantee while increasing per cent rates sent  some blanks forms for guarantor's signatures as granting consent for increase surety`s responsibility. We managed to prove courts among others important arguments that none of the above-mentioned forms of increasing responsibility according credit agreement guarantor did not sign. Therefore surety agreement is terminated. Additionally, we want to congratulate our client that the case about recoverables from the surety more than 27 000 US dollars bank is automatically lost because of the termination of the guarantee by  legal support  of LF "Moskalenko & Partners" .
